Dr. Xaypaseuth Phomsoupha
Managing Partner/Principal Lawyer
Acting as the Principal Lawyer for Phomsoupha & Son Law Co., Ltd (“P&Son”), Mr Xaypaseuth Phomsoupha has specialised in his legal advice surrounding investment law, international commercial, corporate, financial, private and public laws. He serves a wide range of clients, including government agencies, investors, and international agencies, in dealing with commercial contracts without limitation concession and power purchase agreements and project agreements such as credit facilities agreements and related debt instruments. Many major power generation projects, including the Nam Theun 2 HPP-Solar Hybrid PP, Hongsa Coal-Fired Power Plant, Don Sahong HPP, Pak Beng HPP, Xekaman 1 HPP, Xekaman 3 HPP, Sekong 4A&B, Nam Phak Hydro-Solar PP, and infrastructure projects such as Toll Road Project, Paper Pulp, and tourist resorts have used P&Son’s legal service. In respect of international arbitration, during the past 15 years, Mr Phomsoupha has represented a number of Laos-based claimants or respondents in international dispute resolution efforts instituted through SIAC, Singapore, and AIAC, Malaysia. To date, he has been in different roles, partaking in international state-investor arbitration and, thereafter, litigation, the case proceedings of which were heard in various fora and jurisdictions across Asia, the US, and Europe.
Before founding P&Son, Mr Phomsoupha worked in partnership with Sivath & Associates. There, he served various national and international clients with respect to legal services surrounding contract drafting, negotiation, monitoring, and transnational corporate matters for infrastructure power projects.
Prior to the foregoing job, he took several executive positions responsible for legal matters in the government, business, and administrative posts with UNDP. While serving in the Laotian government for over ten years, he led the negotiation team to negotiate project agreements with investors, power sales with peer organisations in neighbouring countries, and financial matters with commercial banks and securities agents and with international financial institutions, including the WB, ADB, EIB, and others.
Mr Xaypaseuth Phomsoupha earned a Doctorate in Public Policy and Administration (public law in modules) from Walden University, MN, USA. He graduated with a Master of Laws (International Commercial Law) at the University of Salford, Manchester, UK, and a Master of Laws (International Financial & Commercial Law) at King’s College, London, UK, and an MA (Applied Economics & International Business Law) at the Australian National University, Canberra, Australia. His first degree was a BA in International Commerce, majoring in International Commercial Law (INCOTERMS) at the Prague University of Economics and Business, Prague, Czech Republic. In widening and deepening legal knowledge during his career, he successfully passed several training courses and was conferred with credentials, including diplomas of International Law (International Arbitration) by the International Law Institute, Georgetown University, Washington DC, USA, and Project Finance Law by the City University, Hong Kong, Drafting International Commercial Agreements in English, Falconbury, London, English Law for Non-UK Lawyers, Redcliffe, London, UK. International Regulatory Affairs, The International Centre for Parliamentary Studies, London, UK. At present, for his post-doctorate effort, Mr Xaypaseuth Phomsoupha is pursuing two respective components related to International Banking Law with the University of Law in Bloomsbury, London, UK, and Private International Law at The Hague Academy of International Law, Hague, Netherlands.
